Arrears and evictions: what the Occupancy Bylaw says

The Occupancy Bylaw contains important details regarding any debts owed to the co-operative along with the relevant procedures. The Occupancy Bylaw includes:

• late payment
• persistent late payment
• failed payments and replacement payments
• advance notice of lateness
• directors in arrears
• repayment schedule and arrears payment agreements
• notice to appear for late or persistent late payment
• eviction procedures
• alternatives when dealing with problems
• performance agreements

A member cannot appeal a board of directors’ eviction decision to the membership if the grounds of termination are:
• Arrears
• Domestic violence
• An act involving violence
• An illegal act, or
• An act or failure to act that impairs the safety of others

The Cooperative Housing Federation of Ontario (CHFC) has information and advice   about the Landlord and Tenant Board and evictions.

The Occupancy Bylaw also contains forms:

– for calling the member to a Board meeting (Notice to Appear)
– to document any decision by the Board of Directors for arrears or for non-arrears situations
–  to be sent to the member(s) to give them official notice of eviction.
– performance agreement forms for arrears and non-arrears situations.
