{"id":8850,"date":"2020-09-10T20:34:10","date_gmt":"2020-09-11T00:34:10","guid":{"rendered":"https:\/\/www.woodsworthcoop.ca\/?p=8850"},"modified":"2025-12-31T17:27:51","modified_gmt":"2025-12-31T22:27:51","slug":"guideline-for-prohibited-conduct","status":"publish","type":"page","link":"https:\/\/www.woodsworthcoop.ca\/index.php\/guideline-for-prohibited-conduct\/","title":{"rendered":"Guideline for Prohibited Conduct: Board policy 2020"},"content":{"rendered":"<p>At its August 19, 2020 meeting, the board approved a Guideline for Prohibited Conduct.<\/p>\n<p>The Board took this step because the board is sometimes faced with instances of problematic conduct. Since eviction isn\u2019t appropriate in many of these circumstances, they felt Woodsworth needed other tools to address them.<\/p>\n<p>The new guideline is based directly on two sections from CHFC\u2019s version 2 of the model Occupancy Bylaw. Our own newly adopted Occupancy Bylaw was based on version 1 and didn\u2019t include these two sections.<\/p>\n<p>The guideline is an extension of the existing section 7.1 (prohibited conduct) in our<a href=\"https:\/\/www.woodsworthcoop.ca\/index.php\/by-laws\/occupancy-bylaw-82\/\"> bylaw<\/a>. It specifically identifies behaviours which are prohibited in that section, such as harassment. It also provides a tool for the board to use in some of these circumstances: no trespass notices.\u00a0We did not change CHFC&#8217;s wording. We simply took that section from the version 2 model bylaw and adopted it as a guideline.<\/p>\n<p>Please note that the guideline is clear that criticism of the board and management is entirely permissible if it is made in a reasonable and constructive way.<\/p>\n<p>By and large, Woodsworth members live cooperatively and treat each other with kindness and generosity. Unfortunately there are exceptions. The board approved the guideline because we needed a framework to address these exceptions.<\/p>\n<hr \/>\n<hr \/>\n<h3>GUIDELINE FOR PROHIBITED CONDUCT<\/h3>\n<p><em>Approved by the Board of Directors on August 19, 2020<\/em><\/p>\n<p>The following two sections are from Version 2 of the CHFC Model Occupancy Bylaw. In the model bylaw, they are labeled 7.9 Criticism of Board and Staff and 7.10 No Trespass Notices.<\/p>\n<p><strong>I.\u00a0 Criticism of Board and Staff<\/strong><\/p>\n<p>Criticism of the job performance of the board of directors and staff is not harassment or a breach of section 7.1 (Prohibited Conduct) if it is made in a reasonable and constructive way. Examples of ways that are not reasonable or constructive include:<\/p>\n<ul>\n<li>making complaints or requests in a loud or threatening or pressing manner<\/li>\n<li>refusing to leave the co-op office or adjacent spaces when asked by staff<\/li>\n<li>\u00a0making any kind of threat or taking any threatening action against directors or staff<\/li>\n<li>making personal statements about staff or directors<\/li>\n<li>making repeated complaints about things that are the same or similar<\/li>\n<li>sending repeated e-mails or voicemails about things that are the same or similar<\/li>\n<li>putting complaints on social media or in other public places<\/li>\n<li>sending complaints to persons outside the co-op in order to embarrass the board or staff.<\/li>\n<\/ul>\n<p><strong>II.\u00a0 No Trespass Notices<\/strong><\/p>\n<p>(a) Prohibited conduct or violence<\/p>\n<p>The board of directors can issue a No Trespass Notice in order to prevent or control\u00a0prohibited conduct or violence.<\/p>\n<p>(b) Limits<\/p>\n<p>A No Trespass Notice to a member, someone in a member\u2019s household or a board-approved sub-occupant can forbid that person from being on parts of the co-op\u00a0property other than the member\u2019s unit and the access to the unit. A No Trespass\u00a0Notice to anyone else can forbid that person from being on co-op property.<\/p>\n<p>(c) Right to review<\/p>\n<p>A member can ask the board of directors to reconsider a No Trespass Notice that\u00a0affects the member or the member\u2019s household, sub-occupants or guests. The request\u00a0to reconsider has to be delivered to the co-op office within five days after delivery or\u00a0posting of the No Trespass Notice. The request must be signed by all co-op members\u00a0in the household. The member will be given at least ten days written notice of a board\u00a0meeting for reconsideration. The member can be present and make submissions with\u00a0or without a representative. The board\u2019s decision will be final and cannot be appealed to the membership. The No Trespass Notice will remain in effect during the\u00a0reconsideration process unless the board decides to suspend it.<\/p>\n<p>(d) Additional reviews after one year<\/p>\n<p>A member can ask the board of directors to reconsider a No Trespass Notice one year\u00a0after it was issued or one year after the last requested review\u2014whichever was later.<\/p>\n<p>The request to reconsider must be signed by all co-op members in the household. The\u00a0member will be given at least ten days written notice of a board meeting for\u00a0reconsideration. The member can be present and make submissions with or without a representative. The board\u2019s decision will be final and cannot be appealed to the\u00a0membership. The No Trespass Notice will remain in effect during the reconsideration\u00a0process unless the board decides to suspend it.<\/p>\n<p>(e) Enforcing No Trespass Notice<\/p>\n<p>The board of directors or co-op staff can take any appropriate action to enforce a No\u00a0Trespass Notice.
